When Are East Bay Workers Entitled To Receive Overtime Pay?

Under the law, employees are classified as salaried employees or those who are hourly.

Salaried employees are those who work for an annual base pay regardless of the number of hours worked. They are considered exempt employees (workers exempt from receiving overtime pay).

Hourly workers, alternately, are paid by the hour. Hourly employees who work any hours above and beyond 40 hours per week in the state of California are entitled to receive overtime pay.

Do You Think You Are Misclassified As An Exempt Employee?

But in some cases, employees are misclassified as salaried — when they shouldn't be. In these instances, they are entitled to receive overtime pay if they are working over 40 hours per week.

If you are a salaried employee who is classified as exempt from overtime and believe you shouldn't be, reach out to our team for guidance. You could be eligible to receive overtime back pay.
